Administrative Law

As you are aware administrative law comes from an enabling statute from a legislative body that allows the administrative body to adopt regulations based on that statute.  In order for a regulation to become administrative law it must be publicized and made available for comment in a book called a register (Chapter 14 Legal Research.)  The Maryland Register serves as the vehicle for our state and the federal Register for the United States.  The final regulations are then placed in books called Codes.  In Maryland it is Code of Maryland Regulation and on the Federal level the Code of Federal Regulation.  Remember all regulation must have some statutory authority.  In the following assignments you will  see how regulation stems from statutory authority.

Maryland Register

Using the COMAR  (Oh no! not again!) website locate the information on the Maryland Register and answer the following questions.

How often is it published?

How many copies are available online?

What kind of general information is available from a copy of the Maryland Register?

How can citizens participate in the regulatory process? 

Requirements

Write an informative letter detailing your findings.  

Include in the memo the proper cite for the register in which you found the information. 

Insert your answer into the Maryland Administrative Law section of the  Paralegal Reference Manual.

COMAR

Using the Maryland Business License Information System choose three licenses from the list.

Print  and read the fact sheet on each license you have chosen.

Locate the statutory authority for the license in the Annotated Code of Maryland

Print the statutory authority for the regulation.

Then find the regulation mentioned in COMAR.

Print a copy of the regulation.

Requirements

Write a memo detailing your findings in relation to the licenses you searched.

Include in the memo the location in the statute giving the authority for the COMAR regulation and the gist of the regulation.

Cite both the statute and the COMAR regulation properly (see above.)

Insert your answer into the Maryland Administrative Law section of the  Paralegal Reference Manual.
