  • Using the following websites or print media answer each of the following questions in an Informative Letter.
  • Please be specific as to where you found the information when citing your answers.

  1. In order to be eligible to take the Maryland Bar Examination how old must you be?
  2. How many times may you fail the Maryland Bar Examination before the Board of Law Examiners can require you to take additional training?

  1. How is the "unauthorized practice of law" defined in Maryland?
    Using the Maryland Law Library website locate the   Annotated Code of Maryland
    Business Occupations and Professions, Title 10
    dealing with practicing law locate and read the Maryland definition for the unauthorized practice of law in § 10-601.
    In order to understand the full context you may need to read additional sections especially § 10-101.  See if you can locate § 10-101. You may want to go to other sections (previous and next to get the full picture.)  

    NOTE: You may locate the appropriate section by clicking on the Maryland Code link on the Homepage of the Maryland Law Library website. It appears as follows:

    Once you have accessed to Annotated Code of Maryland you will need to choose the Business Occupations and Professions Volume and locate   
    §10-601. In this view you will see the titles of the preceding and following sections.

    I recommend that you try both as you will be using the Annotated Code a great deal throughout the course.

     

  2. Using this same hyperlink see if you can find the penalty for the unauthorized practice of law in Maryland. (Hint: it is near the other sections that you have read.)

The following are a number of ways to locate the Maryland Rules of Professional Conduct.

The Maryland Rules of Professional Conduct  are found in the Annotated Code of Maryland,
Maryland Rules,
volume 2, appendix.

ONLINE

In order to access them do the following:

  • Click here
    Maryland's Code of Ethics
  • Read the information to the right of the screen.
  • Click on the plus sign next to Maryland Rules.
  • Go to the fourth item displayed also entitled Maryland Rules.
  • Click on the plus sign.
  • Go to the bottom and you will see
    Appendix: Maryland Rules of Professional Conduct.
  • Click on the plus sign and you will see all of the topics.

Questions Presented

  1. Is a combination of very small errors enough to render an attorney incompetent under the Maryland Rules of Professional Conduct?

  2. May a lawyer collect a contingent fee for representing a criminal client?

  3. Compare the American Bar Association version of Rule 1.6 and the Maryland Rules version of  Rule 1.6 on CONFIDENTIALITY, do you see any differences in the exceptions to the rule?

  4. Under the Maryland Rules of Professional Conduct may a lawyer split fees with a non-lawyer?

  5. Is there a difference between splitting fees and paying a salary?

  6. Is there a difference between splitting fees and paying a salary plus bonus on the amount of fees collected in a given year?
