Maryland Court System

For the Most part the jurisdiction of the Maryland Court System can be found in the Maryland Constitution and the Courts and Judicial Proceedings volume of the Annotated Code of Maryland.
As a practicing paralegal in the state of Maryland I cannot begin to tell you how valuable this information will be to you.   Please take time and learn this very well.

Annotated Code of Maryland
The Maryland Law library allows three methods for searching the Annotated Code of Maryland.
First
When you first enter the site you will see the following notice.  You may search the material using this method.
The advantage is that you can see the entire section of the code and the titles of the sections.

After reaching the cite click on Courts and Judicial Proceedings.

Assignment

Bob was a resident of the State of Maryland.  He took his dry cleaning to Jane's Laundry, a corporation organized under the laws of Maryland, with its principal place of business in Annapolis, Maryland.  Jane's Laundry ruined one of Bob's suits.  Bob now wants to sue Jane's Laundry for a civil tort and seek $500 in damages. 
What state(s) would have personal jurisdiction over Jane's Laundry?
What court(s) would have subject matter jurisdiction over Bob's claim?

Big Bertha's Car Dealership was a Delaware corporation which had a dealership located in Glen Burnie, Maryland.  Big Bertha sold a car to Harry, a Maryland resident.  Harry, however, wrote a bad check in the amount of 12,000 and Big Bertha wanted to sue him for the money. 
What state(s) would have personal jurisdiction over Harry?
What court(s) would have subject matter jurisdiction over Big Bertha's claim?
Assume that Harry wanted a jury trial. What court(s) would have subject matter jurisdiction over Big Bertha's claim?
Assume that Harry was a resident of the district of Columbia and found out Big Bertha's car sale extravaganza on his way to work. What state(s) would have personal jurisdiction over Harry?

Astromat, inc. was a Swedish corporation.  It contracted with art a resident of Ohio, to put new sports floors in the Ravens' stadium, located in Baltimore, Maryland.  Astromat, Inc. breached its contract with Art by failing to plant the correct type of grass seed.  Art sustained $25,000 in damages.  He wants to sue Astromat. 
What state(s) would have personal jurisdiction over Astromat, Inc.?
What court(s) would have original subject matter jurisdiction over Art's claim?
Assume that Art's damages are $100,000.   What court(s) would have original subject matter jurisdiction over Art's claim?
Assume the United States District Court for the District of Maryland awarded damages to Art and Astromat wants to appeal.  What court would have jurisdiction over Astromat's appeal?

Jill, a resident of Maryland, worked for Jack's Auto Body, a Maryland corporation, with its principal place of business in Columbia Maryland.  Jack fired Jill.  Jill believes that her termination was based upon the fact that she is a member of the Mormon religion. She wants to sue Jack to get an injunction in which the court orders Jack to reinstate Jill. 
What state has personal jurisdiction over Jack's Auto Body?
What court(s) would have subject matter jurisdiction over Jill's claim?

  • When you have assembled all of the information, write a separate Memorandum regarding each situation to your supervising attorney discussing your findings and conclusions.

  • Make sure you answer each case problem completely using Maryland Law when there is a state jurisdiction.

  • If you use Maryland Law (where appropriate) cite where you located the answer.

  • Properly cite the source of the Law where you found the answer.
