Introduction
to Paralegal

Module
4

Module 4
includes
chapters 7, 8, 9, 10, 11 and part of chapter 15 in the text. In this module the student will
focus on substantive law. Each paralegal student will
complete courses in many of the topics covered in this module.
Chapter
7 focuses on torts which is largely common law.
Tort law is the basis for malpractice, personal injury litigation,
products liability and many other issues. A knowledge of Tort law is
essential for any paralegal. Torts will be covered
in the LGS171.
Chapter
8 covers both
common law and the Uniform Commercial Code contract law. As anyone knows you
can't live in today's society and not enter into contracts. The
paralegal student will cover more on contracts in LGS253 Business Law I and LGS254
Business Law II.
Chapter 9 focuses on
Real Property Law also known as Real Estate Law, Estates and Family
Law. It is a significant part of the work of many law firms. A paralegal
might also seek employment in title companies, leasing companies, and/ or
banking. In depth material is covered in LGS200 Real Estate
Law for Paralegals online. The basis of estate law is that we are
born and destined for death. No one escapes. A paralegal is
ever present in the law firms specializing in wills, trusts, and estates.
Again these topics will be covered in far greater detail in the Trusts and
/Estates course. The final aspect of this chapter deals with
Family Law. The rapid increase in divorce, remarriage, custody and
property battles has made this the bread and butter of many law firms.
More and more law firms are specializing in this area of the law.
Chapter
10
focuses on one of the most important areas of the law Agency.
This law is the basis for all employment law, as well as, all forms of
business organizations. Agency is covered in LGS 253 Business Law I and
Business Organizations is covered in LGS 254 Business Law II. We will not
spend a great deal of time on this lesson as you will cover it in great
detail later. This chapter
wraps up with intellectual property law.
Chapter 11
is a critical chapter for any student aspiring to become a
paralegal. Government regulation of all areas of our lives is
increasing at a rapid pace. Can you believe that a tax return in
1913 was one side of one page. See what I mean? There are a
growing number of commissions and administrations creating regulation through
enabling statutes passed by Congress and the Maryland General Assembly and
Administrative law has grown quite quickly as an area of specialty for the
paralegal. Your education will continue in this area if you elect to
take LGS Administrative Law. In addition, consumer law, environmental law and
employment law are all to a large extent regulated by regulatory
agencies. Although at the time we have no separate course for
consumer issues some of the issues are covered in LGS 154 Business Law
II.
Chapter
15 deals with
substantive and procedural law. In module 4 we will only deal with
the substantive criminal law. We will deal with the procedural aspects
in module 5. You will continue your paralegal education in this area
by taking LGS215 Criminal Law and LGS216 Evidence and Procedure.
My
goal in this module will be to give you a meaningful and hopefully useful
assignment for each of these areas of law. We do not have time to
delve too deeply into each area as for the most part they will all be covered
in more detail later. We will simply scratch the surface.
It's now time to
begin Module Four.
